Conditions of Sale For This Auction

  1. Unless otherwise agreed, the sale of Lots will result in contracts made between Willowdale Steeplechase, Inc., and the Buyer.
  2. The Buyer shall be the person with the highest bid accepted by the Auctioneer.
  3. The Auctioneer has the right to refuse any bid and to advance the bidding as his absolute discretion and in the case of error or dispute, to put up an item for bidding again.
  4. Statements made by Willowdale Steeplechase, Inc., in this catalogue or made orally or in writing elsewhere, regarding the authorship, origin, date, age, size, medium attribution, genuineness, provenance, condition or estimated selling price of any Lot are merely statements of opinion, and are not to be relied on as statements of definitive fact. Willowdale Steeplechase, Inc. is not responsible for the correctness of any such statement nor for any other errors of description for any faults or defects in any Lots. Catalogue illustrations are for guidance only. Estimates of selling price should not be relied on as a statement that this price is either the price at whice the Lot will sell or its value for any other purpose.
  5. Buyers are responsible for satisfying themselves concerning the condition of the goods and the matters referred to in the catalogue description.
  6. If a prospective buyer gives our representatives instructions to bid on his behalf, by using the form printed in the catalogue, our representatives shall use reasonable efforts to do so, provided these instructions are received no later than 12:00 noon the day of the sale. If our representatives receive commission bids on a particular Lot for identical amounts, and at the auction these bids are the highest bids it will be sold to the person whose bid was received first. Sotheby’s and Willowdale Steeplechase, Inc. are not responsible for any errors with respect to commission, fax or online bids. 
  7. Liability. Willowdale Steeplechase, Inc. cannot be liable for any personal injury or property damage which many arise out of any Lot.
  8. All items for resale have been donated to Willowdale Steeplechase, Inc. Title to the donated goods/services for the sale remains with Donor until sold. 
  9. The Estate and the person designated by it reserve the right to ask any gun to leave the field if he is shooting in a dangerous fashion, and no refund will be given. 
  10. The anticipated bag for the day, subject to weather conditions, is as stated, but no warranty whatsoever is given in this respect.
  11. The Estate and person designated by it reserve the right to cancel the day’s shoot before shooting begins in the event of adverse weather conditions. Buyers may like to take out pluvious insurance to cover such eventualities.
  12. Neither the Estate nor Willowdale Steeplechase are liable for any death or personal injury or loss or damage to equipment arising out of any accident that may occur in the course of any auctioned hunt, shoot or vacation. 
  13. The right to participate in the sporting event is personal to the purchaser and may not be sold, transferred, assigned or otherwise disposed of to any third party.
  14. Following the sale, the Buyer must provide Willowdale Steeplechase, Inc. with his or her name and permanent address.
  15. All Lots are to be paid for in full on the night of the sale at the Payment Desk. All Lots are to be collected by the Buyer on the night of the sale, but no Lot can be taken unless it has first been paid in full. The Buyer will not acquire title to the Lot until all amounts due to Willowdale Steeplechase, Inc. have been paid in full.
  16. These Conditions of Sale are subject to American Law, which shall apply to their construction as well as to their effect. Willowdale Steeplechase, Inc. and the Buyer submit to exclusive jurisdiction of the American courts. From the time of collection, the Lot will be entirely at the Buyer’s risk.
